Correction to MAHC Legal Memo Related to Proposition A and Update on Lawsuit

MAHC Members - Happy New Year!

On December 12, 2024, I sent out information on Proposition A which included a link to a memorandum from our attorney at Husch Blackwell. That memo had an error in the 3rd paragraph on page two where it referenced the law exempting businesses whose gross revenues are $500,000 or more. The "or more" was incorrect and the memo has now been CORRECTED to state "whose gross revenues are $500,000 or LESS".

Additionally, the corrected memo dated today, includes the following update to the status of the lawsuit (also referenced in the original email).

The Court has appointed a trial court judge to have an evidentiary hearing on the issues raised in the lawsuit and to report back to the Supreme Court by February 10, 2025.

MAHC Members,

As you all know, Proposition A passed in November and includes an increase in Missouri's minimum wage and establishes a new paid sick leave requirement.

While the implications to employers is somewhat clear, MAHC did have some questions related to how it may affect the home care industry, specifically the Consumer Directed Services program. I did reach out to our attorney at Husch Blackwell for an opinion.

Of final note, a lawsuit has been filed in the Missouri Supreme Court challenging Proposition A. We will keep you posted on any further developments.
